MOBILE APP TERMS AND CONDITIONS

These are the terms and conditions of 2Bfluent Ltd, a company registered in England and Wales under company number 12096936 with its registered office at 22 City Heights Samuel Ogden Street, Manchester, England, M1 7AX (“we”, “us”, or “our”).

We are VAT registered and our VAT registration number is 435520611.

We own and operate the 2Bfluent mobile app (“2Bfluent”), an application that allows users to practice speaking foreign languages with AI and improve vocabulary through tailored exercises.

These terms and conditions explain the terms under which you use the app to access speaking practice and vocabulary exercises (“Services”).

By signing up and using the Services, you are deemed to have accepted these terms and conditions and you agree to comply with them.

If you don’t accept them, please do not register or use the Services.

We may update these terms and conditions from time to time, so please check back regularly as any updates will apply to you.

Registering for an Account

To create an account (“Account”), you must be at least 4 years old.
We will ask you to create a username and password.
We reserve the right to refuse your creation of an Account if we have reason to believe the information you provide is false or inaccurate.

While the AI is designed to provide a safe and educational experience, its behaviour is not guaranteed to be entirely error-free. Therefore, supervision from a parent or guardian is recommended from time to time for younger users. By registering, you agree to provide accurate information and keep your account credentials secure. Notify us immediately in case of unauthorised access.

Account Privacy

Your Account is personal to you, and so you must not share your login details with any other person.
You will at all times remain completely responsible for all activities on your Account.
If we discover you have failed to maintain the privacy of your Account, or there has been unauthorised access, we reserve the right to suspend your Account without any liability to you until we can investigate.
If you discover someone has accessed your Account without your consent, you must notify us immediately.

Free Trial and Subscriptions

All users receive a 10-day free trial upon signing up. During this period, you will have full access to all features, including: Speaking practice with AI. Vocabulary exercises tailored to your needs. After the 10-day trial, access to features will be locked unless you subscribe to one of the following plans: 1 Month Subscription: Access for 30 days. 3 Month Subscription: Access for 90 days at a discounted rate. 12 Month Subscription: Access for 365 days at the best value. All subscriptions renew automatically unless cancelled before the current subscription period ends. You can manage or cancel your subscription via your App Store or Google Play Store account settings.

To cancel your subscription, please visit your App Store or Google Play Store account settings. Ensure cancellation is done at least 24 hours before the current subscription period ends to avoid being charged for the next cycle.

Services Provided

The app offers the following services: Interactive speaking practice with AI for real-time language improvement. Comprehensive vocabulary exercises to enhance your skills. While we strive to provide an effective learning experience, we do not guarantee fluency or proficiency.

Equipment/Connectivity Issues

You are responsible for ensuring your device meets the necessary technical requirements, including operating system compatibility and a stable internet connection. We are not responsible for any errors or failures that may prevent your access to the app, including but not limited to: Loss of internet connection; Issues with your mobile device or operating system; Problems caused by third-party software, updates, or app store or google play store outages.

Termination

We can terminate your Account with immediate effect by serving written notice if you commit a serious breach of these terms and conditions. Upon termination: Access to subscription features will be revoked immediately. You will not be entitled to any refund for unused subscription periods. You may not reapply for an Account in the future.

AI Disclaimer

While our AI is designed to provide safe and educational interactions, its responses may not always be entirely accurate or error-free. Supervision is recommended for younger users to ensure a productive and appropriate learning experience.

Limitation of Liability and Indemnification

We will not be liable to you, or any third party, whether in contract, tort (including negligence), breach of, or otherwise, for any loss of profit, loss of business, interruption to business, loss of business opportunity, or any indirect or consequential loss arising out of or in connection with these terms and conditions, including but not limited to your use of 2Bfluent or your receipt of the Services.

We have implemented, and maintain, safeguards to ensure the protection and security of the information that we receive.

General Provisions

Force Majeure: Neither you nor we will not be liable to the other for failure or delay in carrying out our obligations under these terms and conditions which is caused by an event beyond our reasonable control, which we could not have foreseen, or which was unavoidable.
This includes but is not limited to acts of God, war, terrorism, civil unrest, explosions, mechanical breakdown, natural disasters, deliberate damage, epidemic, pandemic, government rules or guidance, or failures of suppliers or sub-contractors to do what they are supposed to.
Variation: We may change these terms and conditions from time to time and you must check them for changes because they are binding on you.
Third party rights: Unless it expressly states otherwise, these terms and conditions do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Contract.
Governing Law and Jurisdiction: These terms and conditions and any non-contractual obligations arising hereunder, shall be governed by, and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.
